These Terms of Service ("Terms") govern your access to and use of GrowthSpark CRM ("GrowthSpark," "we," "us," or "our"), including our website, application, and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By creating an account, accessing, or using GrowthSpark, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you may not use the Service.
GrowthSpark is a customer relationship management (CRM) platform designed for Indian small businesses. The Service includes contact management, deal tracking, GST-compliant invoicing, communication tools, analytics dashboards, and related business management features. We may add, modify, or discontinue features at our discretion with reasonable notice.

GrowthSpark offers the following subscription plans:
All prices are in Indian Rupees (INR) and are exclusive of applicable GST (18%). Subscriptions are billed monthly or annually as selected at the time of purchase. Annual plans receive a discount as displayed on our pricing page.
You authorize us to charge your selected payment method on a recurring basis. If a payment fails, we will notify you and may suspend access to paid features until payment is received. You may cancel your subscription at any time from your account settings; access continues until the end of the current billing period.
The GrowthSpark Service, including its design, code, logos, trademarks, and documentation, is owned by GrowthSpark Technologies and protected by Indian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period.
You retain full ownership of all data and content you upload to GrowthSpark. We do not claim any intellectual property rights over your business data. You grant us a limited license to process your data solely for the purpose of providing the Service to you.
To the maximum extent permitted by applicable law, GrowthSpark and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days after account closure, during which you may request a data export. After 90 days, your data will be permanently deleted.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, fail to pay subscription fees, or if required by law. We will provide reasonable notice before termination, except in cases of severe violations where immediate action is necessary.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Tirupati, Andhra Pradesh, India.
In the event of any dispute, claim, or controversy arising from these Terms or the Service, both parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may pursue mediation before a mutually agreed-upon mediator in Tirupati, Andhra Pradesh.
If mediation fails to resolve the dispute within 60 days, either party may initiate arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Tirupati, Andhra Pradesh, India. The language of arbitration shall be English.
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the Service at least 15 days before the changes take effect. Your continued use of GrowthSpark after the effective date constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and close your account.
